This Privacy Policy explains how Jeff Ellis Management, LLC (“JEM,” “we,” “us,” or “our”) collects, uses, anddiscloses information in connection with the website located at jeffellismanagement.com (the “Site”).

This policy applies to the Site only. It does not apply to information collected offline, at pools or facilities we manage, through separate agreements with client organizations, or on other websites we or our affiliates operate, each of which may have its own privacy policy.

1. Information you provide to us

We collect information you choose to submit through the Site, which may include:

• Contact and service request forms — your name, organization, email address, telephone number, facility details, and the contents of your message.
• Class registration and enrollment — participant name, contact details, emergency contact information, class selection, session dates, and any information you provide about a participant’s needs relevant to safe participation.
• Purchases and payments — billing name, billing address, email address, and order details. Payment card details are entered directly into our payment processor and are not received or stored by us (see Section 3).
• User accounts — if you create an account, your username, email address, and password (stored in encrypted form), together with your order and registration history.
• Email subscriptions and surveys — your email address and any responses you choose to give.

Please do not submit sensitive personal information through the Site’s forms unless we specifically requestit for an identified purpose.
 

2. Information collected automatically

Like most websites, our web server automatically records certain technical information when your browser requests a page. This includes your IP address, browser type and version, operating system, the page that referred you, the pages you view, and the date and time of your visit. We use these server logs to operate and secure the Site, diagnose technical problems, and detect abuse. This logging is necessary for the Site to function and to remain secure, and it occurs regardless of your cookie choices.
 

3. Cookies and similar technologies

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect information that may include personal data. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies and other tracking technologies. A cookie is a small file placed on your device when you interact with the Services. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Services. We use a limited number of cookies, described below.
 

Strictly necessary cookies

These are required for the Site to work and are set regardless of your choices:

• Session cookie — maintains your session while you browse and, if you log in, keeps you signed in.
• Cookie consent cookie — records whether you accepted or declined non-essential cookies, so we do not repeat the request on every page.
• Shopping cart and checkout cookies — remember the items in your cart and carry your order through the checkout process.
• Security cookies — help protect forms and checkout against automated abuse.

Payment processing and fraud prevention

We use Stripe, Inc. to process payments. On our cart, checkout, and payment pages, Stripe’s payment scripts load so that card details can be captured securely and so Stripe can perform the fraud and security checks thatprotect both you and us. In doing so, Stripe receives technical information including your IP address and device and browser characteristics.

These payment and fraud-prevention functions are necessary to complete a transaction and are therefore loaded on payment pages regardless of your cookie choices. Stripe’s scripts are not loaded on our general content pages. Card numbers are transmitted directly to Stripe; we do not receive or store full payment card numbers on our systems. Stripe processes this information as described in its own privacy policy.
 

Analytics cookies (only with your consent)

We use Google Analytics 4 to understand how visitors use the Site so we can improve it. Google Analytics collects information such as the pages you view, the approximate geographic region derived from your IP address, your device and browser characteristics, screen size, language setting, and referring pages. Google Analytics does not load and sets no cookies unless you accept cookies through our cookie notice. We do not use GoogleAnalytics advertising features, and we do not use analytics data to build advertising profiles.
 

Embedded third-party content (only with your consent)

Some pages include videos hosted by Vimeo and a social media feed provided by Curator.io. This embedded content is blocked until you accept cookies. If you decline, it is not loaded and no request is made to thoseproviders. If you accept, those providers may set their own cookies and receive your IP address, as described in their respective privacy policies.
 

Your cookie choices

When you first visit the Site, a cookie notice appears asking you to accept or decline non-essential cookies. We use an opt-in approach: analytics and embedded third-party content are not loaded unless you affirmatively accept. Simply scrolling or clicking elsewhere on the page is not treated as consent. 

You may change your mind at any time by clearing the cookies for this Site in your browser through the “Cookie Settings,” which will cause the cookie notice to appear again on your next visit. You can also configure your browser to refuse or delete cookies generally; some parts of the Site, including checkout, may not functionproperly if you do.

We use providers to perform the functions described in this policy. We permit those providers to process information received through the Site only as necessary to provide their services to us and for other purposes described in their applicable terms and privacy notices. We do not authorize providers to use information collected through the Site for our cross-context behavioral advertising. Each provider may also process information under its own privacy terms, and we encourage you to review those terms where applicable.
 

5. How we use information

• To respond to your inquiries and provide the information or services you request.
• To process class registrations, orders, and payments, and to issue receipts and confirmations.
• To administer swim, CPR, first aid, and related programs, and to contact you about a session you have registered for.
• To send updates you have subscribed to (you may unsubscribe at any time).
• To operate, maintain, secure, and improve the Site.
• To detect, investigate, and prevent fraud, abuse, chargebacks, and security incidents.
• To comply with legal obligations and to establish, exercise, or defend legal claims.

 

6. How we disclose information

We disclose personal information only as follows:

• Service providers, contractors and other third parties we use to support our organization andwho perform functions on our behalf,  such as website hosting, payment processing, email delivery, and analytics, and who are permitted to use the information only to provide those services to us.
• Affiliated or subsidiary entities, where necessary to deliver the services you have requested.
• Client organizations and facilities, where a program is delivered at or through a particular facility, to the extent needed to administer the program and manage participation and to fulfill the purpose for which you provide it.
• Professional advisors, such as our attorneys, auditors, and insurers, and who are bound by contractual obligations to keep personal data confidential and use it only for the purposes for which we disclose it to them.
• Legal and safety purposes, where disclosure is required by court order, law, subpoena, or legal process, including to respond to any government or regulatory request, or we believe is necessary or appropriate to protect the rights, property, or safety of any person, including in connection with an incident at a facility.
• Business transfers, in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality protections.

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising.
 

7. Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including to provide requested services, administer registrations, accounts, certifications, and transactions, comply with legal, tax, insurance, accounting, and recordkeeping obligations, prevent fraud and abuse, and establish, exercise, or defend legal claims. We determine the appropriate retention period based on the nature and sensitivity of the information, the purposes for which it is processed, the duration of our relationship with the relevant individual, and applicable legal or operational requirements. We retain server logs for a limited period for security, troubleshooting, and abuse prevention. We may retain registration, certification, order, payment, consent, and suppression records longer where necessary for recordkeeping, legal, tax, insurance, audit, safety, or dispute-resolution purposes.
 

8. Security

We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure, including encryption of traffic to and from the Site and the use of a PCI-compliant payment processor so thatcard details are not stored on our systems. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal data is at your own risk.

The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.
 

9. Children’s privacy

 The Site is intended for adults, including parents, guardians, employers, facilities, and other authorized persons who may register or enroll a minor participant. We do not knowingly collect personal information directly from children under 13 through the Site. When an adult provides information about a minor participant, we use that information to administer the applicable program, training, registration, certification, transaction, or related communication with the responsible adult. If you believe that a child under 13 has provided personal information directly through the Site, please contact us using the information below so that we may investigate and take appropriate action.
 

10. Your choices and rights

• Cookies — accept or decline non-essential cookies through our cookie notice, as described in Section 3.
• Email — unsubscribe from marketing messages using the link in any such message. We may still send you messages necessary to administer a registration, order, or account.
• Account information — if you have an account, you may sign in to review and update your details.
• Access, correction, and deletion — you may request a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it, subject to our legal and recordkeeping obligations.

 

California residents

If you are a California resident, you may have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes for collecting it, and the categories of third parties to whom we disclose it; to request correction or deletion of your personal information; and to not be discriminated against for exercising these rights.

We disclose personal information to the categories of recipients identified in this policy, including service providers, affiliated entities where necessary to provide requested services, client organizations or facilities where necessary to administer a program or training, professional advisors, and parties involved in legal, safety, or corporate-transaction matters. We will not discriminate against you for exercising a privacy right available to you under applicable law.

We retain personal information as described in the Retention section of this policy. We do not sell personal information or share personal information for cross-context behavioral advertising. 

Subject to applicable law and verification of your request, you may request access to, correction of, or deletion of personal information we maintain about you. Because we do not sell personal information and do not share it for cross-context behavioral advertising, we do not offer an opt-out of sale or sharing. To submit a request, contact us using the details in Section 13. We will verify your request before responding, and you may use an authorized agent to submit a request on your behalf.
 

Your State Privacy Rights

Depending on your state of residency, you may have certain rights related to your personal data, including:

• Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible and required by state law, depending on your state], data will be provided in a portable format. Opt- out preference signals and Do Not Track

 Our Sites are configured so that nonessential analytics and embedded-content technologies do not load unless you affirmatively choose to enable them. We do not sell personal information or share personal information for cross-context behavioral advertising. Where applicable law requires us to recognize an opt-out preference signal, we process the signal as required by law. We do not respond to other Do Not Track signals because no uniform industry standard governs their interpretation.
 

11. Links to other websites

The Site contains links to third-party websites, including social media pages and partner or affiliate sites. Clicking such a link takes you to a site we do not control, and this policy does not apply there. We encourage you to read the privacy policy of any site you visit.
 

12. Changes to this policy

 We may update this policy from time to time, and we will provide notice of any such changes to the policy as required by law. The date the privacy policy was last updated is identified at the top of the page. We will notify you of changes to this policy by updating the "last updated" date and posting the updated policy on the Services. We may email or otherwise communicate reminders about this policy, but you should check our Services periodically to see the current policy and any changes we have made to it.
